1. About these terms

These Terms & Conditions govern your use of the MDPC Systems public website. They do not replace a service agreement or subscription terms that may apply if you later subscribe to an MDPC service.

2. Website use

You may use this website for lawful business enquiries and to learn about MDPC Systems. You may not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious code, scrape it in a way that disrupts service, or use it to infringe another person’s rights.

3. Enquiries and onboarding

Submitting the Get Started form is an enquiry only. It does not create a paid account, start a subscription, guarantee approval, or itself create a binding purchase. MDPC will contact you about the next step and any commercial terms that apply.

4. Service descriptions

We aim to describe MDPC services clearly and accurately. Available functionality can differ by plan, business type, configuration and release. Where a paid service is offered, the final agreed features, price, billing period and service terms will be provided before paid access begins.

5. Business-user responsibilities

Businesses using MDPC remain responsible for the accuracy and lawfulness of information they enter, for their relationships with their customers, staff and suppliers, and for complying with laws that apply to their own operations and data processing.

6. Intellectual property

MDPC Systems owns or lawfully uses the website, software, branding, design, text, graphics and other protected material. Except where the law permits, you may not copy, sell, license, reverse engineer, remove proprietary notices from or create unauthorised derivative works from MDPC software or branding.

7. Availability and security

We use reasonable technical and organisational safeguards and work to keep the website and services available. Internet services can experience outages, maintenance and security events, so uninterrupted or error-free availability cannot be guaranteed.

8. Third-party services

MDPC may rely on reputable third-party technology providers for hosting, authentication, communications or other infrastructure. Where a third-party service has its own terms, those terms may also apply to your direct use of that third-party service.

9. Consumer rights

Nothing in these Terms & Conditions excludes or limits any right, remedy or protection that cannot lawfully be excluded under South African law, including rights that may apply under consumer-protection legislation.

10. Liability

To the extent permitted by law, MDPC Systems is not liable for indirect, incidental or consequential loss arising solely from use of this informational website. Any liability connected to a paid service will also be subject to the applicable service agreement and mandatory law.

11. Privacy

Our processing of personal information is described in the Privacy Notice. Our current use of cookies and similar technologies is described in the Cookie Notice.

12. Changes

We may update these website terms when our website, services or legal obligations change. The effective date at the top of this page shows the current version.

13. Governing law

These website terms are governed by the laws of the Republic of South Africa.
